Interpretation and Definitions

Interpretation

Words with an initial capital letter have the meanings defined below. These definitions have the same meaning whether they appear in singular or plural form.

Definitions

For the purposes of these Terms and Conditions:

Affiliate

Means an entity that controls, is controlled by, or is under common control with another party.

Booking

Means a confirmed request for taxi, passenger-transport, airport-transfer, corporate-transfer, parcel-delivery, or related services.

Booking Request

Means information submitted through the Website, telephone, email, or another method requesting a Service. A Booking Request is not necessarily a confirmed Booking.

Company

Means Hobart Executive Taxi Services, also referred to as “the Company”, “We”, “Us” or “Our”.

Country

Refers to Australia. The Company primarily operates in Hobart, Tasmania.

Device

Means any computer, mobile telephone, tablet, or other device capable of accessing the Website.

Driver

Means the driver assigned to provide a transport or delivery service requested by You.

Service

Means the Website and any taxi, transport, airport-transfer, corporate-transfer, door-to-door, maxi-taxi, or parcel-delivery service arranged through the Company.

Terms

Means these Terms and Conditions, which form an agreement between You and the Company regarding use of the Website and Services.

Third-Party Service

Means content, technology, payment services, mapping services, transport providers, social media, or other services supplied by an external provider.

You

Means the individual accessing the Website, making a Booking, travelling as a passenger, or acting on behalf of another person, company, or legal entity.

Acknowledgment and Acceptance

These Terms govern your use of the Website and the agreement between You and Hobart Executive Taxi Services. They describe the rights and obligations relating to the Website and Services.

By accessing the Website, submitting a Booking Request, making a Booking, or using a Service, You acknowledge that You have read, understood, and agreed to these Terms.

If You do not agree with any part of these Terms, You should not use the Website or submit a Booking Request.

You must be legally capable of entering into an agreement. Where a person is under 18 years of age, a parent, guardian, or responsible adult should make the Booking on their behalf.

Your use of the Website is also subject to Our Privacy Policy and Cookie Policy.

Please review the information entered in a Booking Request before submitting it. Incorrect journey, passenger, contact, or flight information may affect the Service.

Booking Requests and Transport Services

Booking confirmation

Submitting an online form or enquiry does not by itself guarantee that a vehicle or Driver has been assigned. A Booking is confirmed only when the Company communicates confirmation to You.

Availability

All Services are subject to vehicle, Driver, location, time, passenger-capacity, luggage-capacity, and operational availability.

Booking information

You should provide complete and accurate information, including:

  • Passenger name and contact details.
  • Pickup and destination addresses.
  • Required date and pickup time.
  • Passenger numbers and luggage requirements.
  • Flight number and expected arrival information for airport pickups.
  • Vehicle preference and any relevant special instructions.

Vehicle selection

Vehicle descriptions and passenger capacities shown on the Website are provided as a general guide. The appropriate vehicle may depend on passenger numbers, luggage quantity, accessibility needs, road conditions, and availability.

Changes and cancellations

Contact the Company as soon as possible if You need to change or cancel a Booking. Any cancellation, waiting, no-show, airport, parking, toll, or other applicable charge should be communicated as part of the Booking arrangement where relevant.

Delays

Pickup and journey times are estimates and may be affected by traffic, weather, road closures, flight changes, accidents, passenger delays, mechanical issues, or other circumstances beyond reasonable control.

Parcel delivery

Parcel-delivery requests are subject to item size, weight, contents, vehicle suitability, and legal requirements. The Company may refuse dangerous, unlawful, prohibited, inadequately packaged, or unsuitable items.

Your Responsibilities

When using the Website or Services, You agree to:

Provide Accurate Information

Ensure all names, contact information, addresses, flight details, times, and passenger information are correct.

Be Ready for Pickup

Be available at the agreed pickup location and time and provide reasonable access instructions where necessary.

Declare Travel Requirements

Inform Us about passenger numbers, large luggage, child-seat requests, mobility needs, or other important requirements.

Use Services Lawfully

Do not use the Website or Service for unlawful, fraudulent, abusive, dangerous, or misleading purposes.

You are responsible for the conduct of passengers included in a Booking made by You and for ensuring they comply with reasonable safety instructions given by the Driver.

Links and Third-Party Services

The Website may contain links to websites, maps, payment systems, advertising platforms, social-media services, or other resources not owned or controlled by the Company.

We do not control the content, availability, security, privacy policies, or practices of third-party websites and services.

To the extent permitted by law, the Company is not responsible for loss arising directly from your independent use of or reliance on third-party content, products, websites, or services.

You should review the terms, privacy policies, and security information of any third-party service before using it or providing personal information.

Suspension and Termination

We may suspend, restrict, or terminate access to the Website or Services where reasonably necessary, including where:

  • You materially breach these Terms.
  • Fraudulent, abusive, unlawful, or unsafe activity is suspected.
  • False or misleading booking information is provided.
  • Website, payment, booking, or security systems are being misused.
  • Suspension is required to protect passengers, Drivers, the Company, or another person.
  • We are required to act by law or a competent authority.

Termination of Website access does not affect rights, payments, obligations, or liabilities that arose before termination.

Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, remedy, condition, or warranty that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.

Where the Australian Consumer Law applies, Services come with consumer guarantees, including guarantees that applicable services will be provided with due care and skill.

Your Statutory Rights Remain Protected

Any exclusion, disclaimer, or limitation in these Terms applies only to the maximum extent permitted by law.

Limitation of Liability

To the maximum extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, or consequential loss arising from use of or inability to use the Website or Services.

This may include loss resulting from:

  • Traffic delays, road closures, weather, accidents, or flight disruption.
  • Incorrect or incomplete information provided by the customer.
  • Third-party websites, mapping tools, payment systems, or communication services.
  • Loss of data, business opportunity, profit, or expected savings not directly caused by the Company.
  • Events outside the Company’s reasonable control.
  • Unauthorised use of your Device, email account, telephone, or booking information.

Where liability cannot legally be excluded but may lawfully be limited, the Company’s liability will be limited only to the extent permitted by applicable law.

This section does not exclude liability for fraud, wilful misconduct, personal injury caused by negligence where liability cannot be excluded, or any other liability that the law does not permit the Company to exclude.

“As Is” and “As Available” Disclaimer

Subject to rights that cannot be excluded by law, the Website is provided on an “as is” and “as available” basis.

We do not guarantee that:

Continuous Availability The Website will always be available, uninterrupted, or free from technical delays.
Error-Free Operation Every error, defect, display issue, or technical problem will be immediately corrected.
Complete Accuracy All website content, availability, travel times, or third-party information will always be complete or current.
External Security External websites, networks, emails, or third-party services will be free from harmful components.

We may update, correct, suspend, remove, or change Website content and functionality where reasonably required.

Governing Law and Dispute Resolution

Governing law

These Terms are governed by the laws applicable in Tasmania, Australia, together with applicable Commonwealth laws.

Subject to any rights You may have under consumer law, the parties submit to the courts and tribunals having jurisdiction in Tasmania.

Informal dispute resolution

If You have a concern or dispute about the Website, a Booking, or a Service, You agree to first contact the Company and provide reasonable details of the issue so that the parties can attempt to resolve it informally.

Nothing in this section prevents either party from seeking urgent legal relief or exercising a right available under applicable consumer law.

Severability, Waiver and Interpretation

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable.

If it cannot be made enforceable, it will be severed without affecting the remaining provisions.

Waiver

A failure or delay by either party to exercise a right or require performance of an obligation does not waive that right or obligation.

A waiver relating to one breach does not constitute a waiver of a later or continuing breach.

Translation

These Terms may be translated for convenience. Where there is an inconsistency between a translated version and the original English version, the English version will prevail to the extent permitted by law.

Entire agreement

These Terms, together with any confirmed booking-specific conditions, Privacy Policy, Cookie Policy, and other policies expressly incorporated into them, form the agreement relating to your use of the Website and Services.

Changes to These Terms

We may modify or replace these Terms to reflect changes to the Website, Services, business practices, legal requirements, or operational arrangements.

Where a change is material, We will make reasonable efforts to provide notice through the Website or another appropriate communication method before the change takes effect.

The latest version will be published on this page with an updated revision date.

By continuing to use the Website or Services after revised Terms take effect, You agree to the revised Terms. If You do not agree, You should stop using the Website and Services.
